General Terms and Conditions of Sale
Article 1: Purpose
These terms and conditions of sale define the contractual relationship between the publisher and the customer, as well as the conditions applicable to any purchase made on the website, whether the customer is a professional or an individual.
The purchase of a Product implies the Customer's unconditional acceptance of these terms and conditions of sale. These terms and conditions of sale shall prevail over any other general or specific terms not expressly agreed to by the publisher.
The publisher reserves the right to modify the terms and conditions of sale at any time. The applicable terms and conditions are those in force on the date of the Customer's order.
Article 2: Force Majeure
The obligations stipulated in these General Terms and Conditions of Sale shall be suspended in the event of a force majeure event as defined by the case law of the French courts. The respective obligations of the parties shall first be suspended for the entire duration of its existence, with the exception, however, of the obligations stipulated in Article 14 and in the Appendix.
Article 3: Product Features
The Product is the one presented on the page of the website that describes it and contains the purchase button.
Article 4: Prices
The price shown on the sales page is in Euros, all taxes included. Any order, regardless of its origin, is payable in euros.
The publisher reserves the right to modify the price at any time. The price shown on the sales page on the day of the order is the only one applicable to the Customer. The customer located outside metropolitan France will pay higher shipping costs than customers in metropolitan France.
Article 5: Payment Terms
Payment is due upon order. For payments by check, the order is only shipped upon receipt of the check in question, as well as for payment by bank transfer. Failure to pay results in the suspension or cancellation of the order.
Payment can be made by credit card. It will then be secured by La Banque Postale, which uses the SSL (Secure Socket Layer) protocol so that the transmitted information is encrypted by software and no third party can access it during transmission over the Internet.
Payment can also be made via PayPal (PayPal Europe S.à r.l. & Cie, S.C.A. 22-24 Boulevard Royal. 5th floor. 2449 Luxembourg), which uses the SSL (Secure Socket Layer) protocol so that the transmitted information is encrypted by software and no third party can access it during transmission over the Internet.
The Customer is not required to have a PayPal.com account to pay for the order. On the PayPal.com payment page, there is an option for non-PayPal.com account holders that the Customer can use.
As the publisher is not responsible for the paypal.com or cmcicpaiement.fr website, it cannot in any way be held responsible by the Customer for the consequences of their misuse of the said websites, nor for the unavailability of this website should such an eventuality arise.
Article 6: Delivery Area
The sale of the Product on the Website is reserved for Customers whose country of residence is authorized by PayPal.com (approximately 140 countries – see the list on the PayPal.com website).
Article 7: Order
The Customer acknowledges having verified the suitability of the Product for their needs and having received from the publisher all the information necessary for them to enter into this commitment fully informed.
The Customer declares that they have the legal capacity or are the holder of parental authorization allowing them to place an order on the Website.
The Customer declares that the bank account associated with the payment card or the PayPal.com account they use during payment is their own or that they have the legitimate authorization of its owner to use it.
Article 8: Proof of Transaction
All the data provided and the confirmation recorded on the PayPal.com payment website shall serve as proof of the transaction. The confirmation shall serve as signature and acceptance of the operations carried out.
Article 9: Delivery
The Product is delivered by post, and only by this means, unless previously agreed before the order with the publisher.
The indicated delivery times are the most common times and are for guidance only; the publisher undertakes delivery between 1 and 3 days excluding weekends and holidays except in cases of force majeure. The publisher cannot be held responsible for the mishaps of La Poste. The delivery times for international shipments are 5 to 10 days.
Article 10: Order Confirmation
The publisher will communicate an order confirmation by email. This email is sent automatically by the e-commerce system used on the Website.
Article 11: Refund
The Customer has a period of 10 days from the delivery date to exercise their right to a refund. Any refund request will be made by post or electronically to the publisher.
The Customer who has made a refund request undertakes on their honor not to use the product and to resend it at their own expense. If one of the products is not returned in its original condition, the refund of the said product will not be issued.
Upon request, the publisher undertakes to refund the Customer within ten business days from the date of receipt of the said request. Unless explicitly agreed between the two parties, the refund will be made via the PayPal website or by check.
Article 12: Publisher's Commitments
The publisher undertakes to exercise all the care and diligence necessary to provide a quality product and service in accordance with professional practices, particularly in terms of communication with the Customer.
The publisher undertakes to take all reasonable precautions to ensure the physical protection of the Customer's personal data and to ensure their confidentiality.
Article 13: Liability
The Product complies with current French legislation and the standards applicable in France. The publisher cannot be held liable in the event of non-compliance with the legislation of the country where the Product is delivered. It is up to the Customer to check with the local authorities of their country of residence the possibilities of use of the Product they intend to order on the Website.
The publisher cannot be held responsible for the non-delivery of the Product if the Customer's address provided on the PayPal.com payment website or by any other means is outdated or invalid, or if the Customer's mailbox is inaccessible or non-functional.
Article 14: Intellectual Property

Article 17: Severability Clause
If any of the conditions herein should prove to be null, the said clause shall be deemed unwritten but shall not result in the nullity of the rest of the general terms and conditions of sale, which will therefore remain fully valid.
Article 18: Dispute Resolution
These online sales terms and conditions are subject to French law regardless of the place of use or acquisition.
